About These Terms

The Run This websites, mobile applications, and services (the "Services") are provided by Run This, LLC ("Run This", "we", "us", or "our"). You may use the Services only if you agree to these Terms and are legally capable of forming a binding contract. By accessing, using, or uploading or downloading any information or materials to or from the Services, or by indicating your assent to these Terms by creating an account, clicking "Sign up" or any similar mechanism, you are agreeing to these Terms. If you do not agree to these Terms, do not access or use the Services. This agreement was written in English. To the extent a translated version of the Terms conflicts with the English version, the English version controls.

If you access or use the Services on behalf of a company or other entity, you represent that you have authority to bind such entity and its affiliates to these Terms and that it is fully binding on them. In such case, the term "you" will refer to such entity and its affiliates. If you do not have authority, you may not access or use the Services. These Terms contain disclaimers of warranties and limitations on liability that may be applicable to you.

Registration and Accounts

The Services are intended solely for persons who are at least 13 years old or such higher age as required in your country to use the Services. If you are under the legal age to form a legally binding contract in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If you are a parent or legal guardian of a Run This user under the legal age to form a binding contract in your jurisdiction, you agree to be fully responsible for the acts or omissions of such user, including any breach of these Terms. Notwithstanding, Run This reserves the right to refuse access to the Services by users under certain ages, in our sole discretion.

To use the Services, you must register. In doing so, you agree to: (a) provide true, accurate, current and complete information about yourself (“User Data”) and (b) maintain and promptly update the User Data. You agree that Run This may use your User Data to provide Services that you access or use and as otherwise set forth in these Terms and our Privacy Policy. You also agree to create only one account for your own personal use and not share your account or Run This subscription with others. You agree that all activities associated with your account on the Services reflect authentic activities undertaken by you. If you provide any User Data that is inaccurate or not current, you have created multiple accounts, or Run This has reasonable grounds to suspect that such User Data is inaccurate or not current, Run This has the right to suspend or terminate your account and refuse current or future use of the Services. In consideration of your use of the Services, you represent that you are not a person barred from receiving services under the laws of any applicable jurisdiction.

You are solely responsible for maintaining the confidentiality of the password associated with your account and for restricting access to your password, your computer and mobile device while logged into the Services. You accept responsibility for all activities that occur under your account or from your computer and mobile devices. You agree to immediately notify Run This of any unauthorized use of your account or password, or any other breach of security, and confirm that you understand all risks of unauthorized access to User Data and any other information or content you provide to Run This. The use of unique and complex passwords is highly recommended for security reasons.

You may register for or log in to your account via a third-party network, such as Facebook, Google, or Apple. If you do so, you will authorize Run This to pre-populate the registration and other relevant information fields of your account and/or to use such third-party credentials to log you into your account, based on those companies’ privacy policies. If you connect your account to a third-party network, you agree to comply with the terms and conditions and policies applicable to such third party.

By virtue of certain of the Services connecting to third-party APIs, you hereby agree to be bound by those providers’ terms of service and privacy policies in connection with your use of such Services.

User Conduct

You agree to use the Services in a respectful and lawful manner. You will not: post or share content that is offensive, abusive, harassing, defamatory, obscene, sexually explicit, violent, discriminatory, or otherwise objectionable; engage in bullying, harassment, or threats against others; post illegal content or promote illegal activities; impersonate any person or entity; or attempt to hack, disrupt, or misuse the Services.

Your use of the social features is also governed by our Community Guidelines (available at /guidelines), which are part of these Terms. We may remove any content, restrict features, or suspend or terminate your account if you violate these Terms or the Community Guidelines. Users may report objectionable content through the app, block other users, and we review reports promptly.

Your Content and Social Features

The Services include social features: public profiles, a feed, event walls, comments, polls, photos and videos, clubs, communities, teams, fundraising circles, and direct and group messages. You retain ownership of any content you submit through the Services. By submitting content, you grant Run This a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute your content for the purpose of operating, promoting, and improving the Services.

Content you post to public surfaces (your public profile, event walls, club and community pages, comments) may be visible to other users and to the public. Messages are visible to the participants in the conversation. Privacy controls (such as a private profile) are described in our Privacy Policy.

We may remove or restrict content that violates these Terms or the Community Guidelines, and we may preserve and disclose content as described in our Privacy Policy. If you delete your account, your content is removed or anonymized as described in the Privacy Policy's Data Retention and Account Deletion section.

Events and Registrations

Run This allows you to join events, races, and meetups organized by third parties. We are not responsible for the quality, safety, legality, or conduct of any event or organizer. Your participation in events is at your own risk.

Some events may require payment. Refund policies for events are set by the event organizers and shown during registration; refund decisions are the organizer's responsibility, and Run This platform and payment-processing fees are non-refundable as disclosed at checkout.

Payments

Payments on the Services are processed by Run This through its payment processor (Stripe). For registration and related transactions, Run This acts as the settlement merchant of record, and the charge on your statement may appear from Run This; the funds you pay (less the disclosed fees) are settled to the event's payment account. The total price, including any platform, processing, or timing fees, is shown before you pay.

If you believe a charge is in error, contact us before disputing it with your card issuer — most issues are resolved faster that way. Chargebacks and payment disputes are handled through our payment processor.

Information Sharing with Event Organizers

When you register for a race or event through the Services, the event organizer (such as a race director or club administrator) may receive certain information you provide, such as your name, contact details, address, registration information, and emergency contact information. By signing up for an event, you consent to this information being shared with the organizers for the purpose of managing the event.

We do not sell your personal information to third parties. Information is only shared with event organizers as necessary to operate the Services and fulfill your registrations.

Event organizers are independently responsible for handling and protecting any information they receive from you according to their own privacy policies and practices. We encourage you to review the privacy policy of each event organizer before submitting your information.

Disclaimers

The Services are provided "as is" without warranties of any kind. We do not guarantee the accuracy, reliability, or availability of the Services or any content therein.

Participation in physical activities like races carries inherent risks. You acknowledge and accept these risks by using the Services.

Limitation of Liability

To the maximum extent permitted by law, Run This is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data arising out of your use of the Services.

Indemnity

You agree to indemnify and hold harmless Run This, its affiliates, officers, and employees from any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Tennessee. Any disputes arising under these Terms will be resolved through binding arbitration in Nashville, TN, except that (a) either party may bring an individual claim in small-claims court, and (b) either party may seek injunctive or equitable relief for violations of intellectual property rights. This same dispute-resolution posture applies to the Organizer Agreement, so a person who is both a user and an organizer has one forum.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website or app. Your continued use of the Services after any changes constitutes acceptance of the new Terms.
